Welcome to Majhghar, a real estate marketplace for Pune and PCMC. These Terms & Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using Majhghar, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Platform.

"Platform" refers to the Majhghar website, mobile application, and all related services.

"User" refers to any person who accesses or uses the Platform, including property owners, brokers, builders, buyers, tenants, and visitors.

"Listing" refers to any property, project, or requirement posted on the Platform by Users.

"Owner" refers to the legal owner of a property or project listed on the Platform.

"Broker" refers to a real estate agent or intermediary who lists properties or projects on the Platform.

"Builder" refers to a real estate developer or construction company listing projects on the Platform.

By creating an account, posting a listing, or using any service on Majhghar, you acknowledge that you have read, understood, and agree to these Terms. Majhghar reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

You must be at least 18 years old to use Majhghar. By using the Platform, you represent and warrant that you are legally competent to enter into binding contracts. If you are using the Platform on behalf of a company or entity, you represent that you have the authority to bind that entity to these Terms.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Majhghar immediately of any unauthorized use of your account. You are responsible for all activities that occur under your account. Majhghar reserves the right to suspend or terminate accounts that violate these Terms.

Majhghar is ONLY a digital marketplace. We provide a platform connecting buyers, tenants, property owners, brokers, and builders. Majhghar does NOT:

• Act as a broker or agent
• Own any listed properties or projects
• Participate in transactions between Users
• Collect brokerage or commission from Users
• Verify ownership of every listing
• Verify legality of properties or projects
• Verify RERA registration or compliance
• Verify government approvals
• Verify title documents
• Verify possession status
• Verify pricing accuracy
• Verify property availability
• Guarantee the authenticity of any listing

Property Owners, Brokers, and Builders may list properties and projects on Majhghar. By posting a listing, you represent and warrant that:

• You are the legal owner or authorized representative of the property/project
• All information provided is accurate, complete, and not misleading
• The listing complies with all applicable laws, including RERA regulations
• You have the legal right to sell, rent, or lease the property
• Images and descriptions truthfully represent the property
• Pricing is genuine and not artificially inflated

Majhghar reserves the right to remove, edit, or reject any listing at its sole discretion without prior notice.

Builders listing projects on Majhghar must ensure that:

• The project is registered with RERA where applicable
• All necessary government approvals are obtained
• Project details including timeline, specifications, and amenities are accurate
• Marketing materials do not make false or exaggerated claims
• Payment schedules and possession timelines are realistic

Brokers listing properties on Majhghar must:

• Disclose their broker status clearly in listings
• Have proper authorization from property owners
• Provide accurate information about properties
• Not misrepresent their relationship with properties
• Comply with all applicable real estate regulations

Users of Majhghar agree to:

• Provide accurate and truthful information
• Verify all property details independently before making any payment
• Conduct due diligence on property ownership, title documents, and legal status
• Verify RERA registration and compliance for projects
• Check government approvals and permissions
• Confirm possession status and timelines
• Validate pricing through independent sources
• Meet sellers/brokers in person before making payments
• Use proper sale agreements and legal documentation
• Report suspicious or fraudulent listings

The following activities are strictly prohibited on Majhghar:

• Posting fake, fraudulent, or misleading listings
• Misrepresenting ownership or authorization
• Posting properties you do not own or have rights to
• Using fake identities or impersonating others
• Spamming users with unwanted communications
• Harassing, threatening, or abusing other Users
• Attempting to manipulate reviews, ratings, or listings
• Posting illegal or prohibited content
• Engaging in fraudulent transactions or scams
• Violating any applicable laws or regulations
• Circumventing platform fees or policies
• Using automated tools to scrape or abuse the Platform

Majhghar reserves the right to:

• Review and moderate all listings
• Remove or edit listings that violate these Terms
• Suspend or ban Users who violate these Terms
• Report fraudulent activities to authorities
• Cooperate with law enforcement investigations
• Disable accounts engaged in suspicious activity

When Users contact each other through Majhghar, contact information may be shared between the parties. Majhghar is not responsible for the quality of leads or the outcome of such communications. Users should exercise caution when sharing personal information.

All content on Majhghar, including text, graphics, logos, images, and software, is the property of Majhghar or its licensors and is protected by copyright and other intellectual property laws. Users may not use, reproduce, or distribute any content from Majhghar without prior written permission.

By posting content on Majhghar, Users grant Majhghar a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for the purpose of operating the Platform.

Majhghar may contain links to third-party websites. These links are provided for convenience only. Majhghar does not endorse, control, or take responsibility for the content, privacy policies, or practices of third-party websites. Accessing third-party links is at your own risk.

Majhghar reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Termination may result in the loss of all account data and listings. Majhghar shall not be liable to you or any third party for any termination of your account.

Majhghar shall not be responsible for:

• Fake or fraudulent listings
• Financial loss due to scams or fraud
• Legal disputes between Users
• Payment disputes or non-payment
• Title disputes or ownership issues
• Broker disputes or commission issues
• Builder disputes or project delays
• Delays in possession or project cancellation
• Construction quality issues
• Inaccuracies in property information
• Any direct or indirect damages arising from Platform usage

Users transact entirely at their own risk. Majhghar provides the Platform "as is" without any warranties, express or implied. In no event shall Majhghar be liable for any indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify, defend, and hold harmless Majhghar, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
